The Western Cape Government's Department of the Premier is advertising three vacancies for State Law Advisor: Legal Governance. These positions sit within the legal governance component of the department, offering an opportunity for experienced legal professionals to contribute to the sound administration of the provincial public sector. The roles are graded according to the Occupation Specific Dispensation (OSD) and offer an all-inclusive salary package, with appointment possible at either of two levels depending on the candidate's experience. The posts are based in the Western Cape and involve working closely with provincial departments, public entities and municipalities.
To be considered, applicants must hold an LLB degree and be admitted as an Advocate or Attorney. For appointment at the lower level, a minimum of five years of appropriate post-qualification legal experience is required, while the higher level demands at least nine years of such experience. A valid Code B (or higher) driving licence is also required, although candidates with disabilities that restrict driving but who have reasonable access to transport are encouraged to apply. The ideal candidate will have a thorough understanding of constitutional, legal and institutional arrangements governing the South African public sector, including Constitutional Law, the Promotion of Access to Information Act (PAIA), the Promotion of Administrative Justice Act (PAJA), the Protection of Personal Information Act (POPIA), the Interpretation of Statutes, and procurement and tendering processes. Familiarity with relevant legislation, case law and litigation trends, as well as the regulatory frameworks and best practices that influence line functions, is essential. Strong computer literacy in the MS Office package, the ability to work independently and as part of a team, exceptional written and verbal communication, presentation and facilitation skills, and project management capabilities are all required.
The core duties of the role are varied and high-impact. The successful candidates will render legal training to departments, public entities and municipalities, helping to build capacity across the provincial sphere. They will provide legal research and advisory services on governance matters, including proactive counsel to the executive and departments. They will also conduct legal governance assessments and produce reports for provincial departments and entities. A significant part of the work involves rendering transversal legal governance services in respect of PAIA, PAJA, POPIA and other constitutional legislation. In addition, the role includes reviewing and maintaining delegations for members of the executive and departments, ensuring that authority is properly delegated and exercised.
Shortlisted candidates should note that the selection process includes interviews, a practical exercise to assess technical and generic suitability, and an integrity assessment. They will be required to submit duly completed vetting and supporting documentation within a specified timeframe, and failure to do so without reasonable justification may result in exclusion from the process. By applying, candidates consent to the Western Cape Government contacting previous employers for references, including disciplinary records and reasons for leaving. The selection process will be guided by the employment equity targets of the department. Applications must be submitted online before the closing date, as late submissions will not be considered. This is an excellent opportunity for a legal professional with a strong governance background to make a meaningful contribution to the public sector in the Western Cape.
