This vacancy is for a Senior State Advocate within the National Prosecutions Service (NPA), based at the Directorate of Public Prosecutions in Durban. It is a re-advertised post at a senior prosecutorial level, offering a total cost-to-company package on the LP-9 salary scale. The successful candidate will operate within a high-stakes legal environment, taking a leading role in the prosecution of serious, complex, and organised crime, as well as terrorism and terror financing matters. The position demands a seasoned legal professional who can act independently and with credibility, representing the State in court and providing strategic guidance to law enforcement during criminal investigations.
Applicants must hold an LLB degree, or an appropriate legal qualification for serving prosecutors seeking promotion. A minimum of eight years of post-qualification legal experience in civil and/or criminal litigation is required, along with the right of appearance as contemplated in section 25(2) of the NPA Act. Demonstrable competency in acting professionally, accountably, and with credibility is essential. The role requires a thorough knowledge of POCA legislation, a willingness to travel, and the ability to work extended hours. Strong advocacy skills, well-developed legal research and drafting abilities, and a good working knowledge of civil and criminal procedure are critical. Familiarity with asset forfeiture law will be an added advantage, as will proficiency in MS Word, Excel, Outlook, and PowerPoint. Candidates must also possess excellent written and verbal communication skills, sound interpersonal skills, and the capacity to work independently.
The core duties of the post are extensive and demanding. The Senior State Advocate will conduct prosecutions in serious, complex, and organised crime cases, as well as terrorism and terror financing matters. This includes advising the police on the investigation of such cases, conducting legal research, and staying abreast of legal developments. The incumbent will draft charge sheets and other court documents, represent the State in all courts, draft heads of arguments, and argue appeals. Courtroom responsibilities include presenting cases, leading witnesses, cross-examining, and addressing the court on conviction and sentence. The role also involves appearing in motion proceedings, handling appeals and reviews, and generally conducting prosecution on behalf of the State.
Several important conditions apply to this position. Successful candidates will be subjected to a security clearance of at least confidential, and appointment will be provisional pending the outcome of that clearance. Fingerprints will be taken on the day of the interview, and the social media accounts of shortlisted applicants may be accessed as part of verification. A valid driver’s licence is required where applicable. Shortlisted candidates will undertake pre-entry assessments, including a practical exercise and an integrity assessment. The NPA reserves the right not to fill the post, and applicants who do not receive feedback within six months of the closing date should consider their application unsuccessful. It is also noted that the NPA cannot pay resettlement costs. This is a demanding but rewarding opportunity for an experienced litigator seeking to contribute to the fight against serious crime within a key South African prosecuting authority.
