This is a senior legal role within the National Department of Forestry, Fisheries and the Environment, based in Pretoria, and two incumbents will be appointed. The position is graded under the Occupation Specific Dispensation and sits within the litigation support function, where the main focus is to manage court matters and provide high-quality legal support that enables the Department to protect and conserve the environment. The role is demanding and strategic, requiring close collaboration with the State Attorney, legal counsel, and other stakeholders, as well as regular travel to various courts and site inspections. Candidates must therefore be willing to work long hours and be ready to respond to matters that require urgent attention.

Applicants must hold an LLB degree or an equivalent qualification recognised by the South African Qualifications Authority, together with a minimum of eight years of post-qualification experience in the provision of legal services. A sound working knowledge of Administrative Law, Constitutional Law, Environmental Law, the Promotion of Administrative Justice Act, and the rules of the High Courts and Magistrate’s Courts is essential. Practical experience in judicial review applications is also required, while knowledge of environmental laws will be an added advantage. The ideal candidate will demonstrate strong organisational and planning skills, computer literacy, creativity, basic project management ability, and excellent communication, presentation and reporting skills. Analytical, research and drafting abilities are equally important, as are teamwork, a proactive and problem-solving attitude, and the capacity to meet tight deadlines. Leadership, facilitation, and strong diplomatic skills are also essential, along with a valid Code B driver’s licence and a willingness to travel.

The main duties of the post include managing litigation matters and determining liability for losses and damages to State property, particularly where officials or third parties have caused damage to State assets or vehicles. The officer will facilitate the recovery of such obligations with the assistance of the State Attorney. The role also involves providing litigation management services and general legal advice, ensuring the Department complies with the legislative framework relevant to its core business and with the Rules of Court. In addition, the officer will assist the Department to comply with the Promotion of Administrative Justice Act, conduct training and information-sharing sessions on litigation and losses and damages to State property, and provide legal support on the interpretation of environmental legislation and appeal matters under the Promotion of Access to Information Act and PAJA. The post holder will compile court records, consult with legal counsel on appeal decisions taken on review, and draft ministerial submissions.

The Department is an equal opportunity, affirmative action employer, and preference may be given to appointable applicants from underrepresented designated groups in line with its equity plan. Persons with disabilities are encouraged to apply. Shortlisted candidates will be subjected to screening and security vetting, which may include criminal record checks, citizenship status verification, creditworthiness assessment, reference checks and qualification verification. Foreign qualifications must be evaluated by SAQA, and shortlisted candidates will be required to submit certified copies of their qualifications, senior certificate, identity document and driver’s licence before the interview. Correspondence is limited to shortlisted candidates only. Applicants should also note that a signed Z83 form and a detailed CV are required for the application to be considered, and all appointments are subject to the Department’s vetting and verification processes. This is a challenging and rewarding opportunity for an experienced legal professional to contribute meaningfully to environmental governance and the enforcement of environmental law in South Africa.
