The successful candidate will be required to provide Advisory and Legal Support/Service nationally, which includes, but is not limited to the following: drafting of legal agreements and vetting of loan related documents and commercial agreements, supervision of bond registrations by external bond conveyancers; reviewing contracts; research and drafting legal opinions and Legal due diligence; all whilst ensuring that SEDFA achieves its mandate in a legally compliant manner where all legal risks have been sufficiently managed or mitigated..
Requirements
Qualifications NQF Level: 8 Law degree recognised by the Law Society of South Africa) is required. Admitted Attorney/Advocate of the High Court NQF level 9 will be an added advantage Experience 3 years relevant legal advisory experience. Experience drafting and negotiating commercial agreements. Experience in governance and regulatory compliance. Experience managing litigation and external legal service providers. Experience within a Development Finance Institution (DFI), public entity, financial services sector, banking environment, or government institution. Exposure to lending, investments, recoveries, and public sector governance. Duties
Legal drafting, vetting and review of service level agreements, commercial agreements, Provide legal opinions and advice to management, business units, and committees on legal, regulatory, and commercial matters. Interpret legislation, regulations, policies, and legal frameworks applicable to SEDFA. Advise on governance, corporate, employment, procurement, lending, and commercial matters. Monitor legislative developments impacting the organisation and provide recommendations. Provide legal advice on the selection of the most appropriate entity for transactions. Ensure that legal risks are assessed and managed and/or mitigated in all transactions to ensure that SEDFA’s exposure is managed Provide legal direction and advice that considers prevailing legal prescripts and ensure that decisions are taken within the relevant legislative parameters and enforcing legislative compliance. Build relationships with business units and external stakeholders. Liaise with external legal service providers. Represent SEDFA in legal discussions and negotiations. Advise management on governance frameworks and regulatory compliance requirements. Review board submissions and governance documentation from a legal perspective. Review board submissions and governance documentation from a legal perspective. Draft and review legal policies, procedures, frameworks, and delegations of authority. Ensure organisational policies remain aligned with legislative requirements.
