DISTRICT COURT CONTROL PROSECUTOR

The District Court Control Prosecutor position within the National Prosecutions Service (NPA), based at the Middelburg (Ermelo) office, is a senior and demanding legal role focused on overseeing and strengthening the quality of prosecution in the District and Regional Courts. The incumbent will act as a mentor, supervisor and trainer to a team of prosecutors, while also carrying a personal caseload of complex criminal proceedings. Operating within the broader criminal justice system, the role is central to ensuring that the State’s cases are prepared thoroughly, presented professionally, and conducted in accordance with the NPA’s code of conduct, policies and directives. The position also involves administrative oversight, staff performance support, and fostering collaboration with external partners such as the police, courts and community stakeholders.

Candidates must hold an LLB degree, or an appropriate legal qualification for serving prosecutors applying for promotion, coupled with at least four years of post-qualification legal experience. The role requires demonstrable competency in acting independently, professionally, accountably and with credibility, as well as the ability to function with minimal supervision. Strong prosecution and litigation skills are essential, including competence in guiding investigations, providing legal instructions on statutory offences, and handling matters in the District Court. The ideal candidate will bring good interpersonal, analytical, presentation and project management abilities, and must hold a valid driver’s licence.

The core duties are wide-ranging. The Control Prosecutor will manage, train and give guidance to prosecutors, review case dockets and decide whether to institute criminal proceedings, and handle maintenance matters and inquests of a general and more advanced nature in both the Regional and District Courts. The role requires preparing cases for court, drafting charge sheets and other legal documents, and presenting the State’s case in court, including leading witnesses, cross-examining, and addressing the court on conviction and sentence. In addition to litigation responsibilities, the incumbent will assist the Senior Public Prosecutor with staff performance assessments, undertake general administrative duties of the office, and actively promote partner integration, community involvement and customer satisfaction alongside other criminal justice system role players.

Several notable conditions attach to the post. Successful candidates will be subjected to a security clearance of at least confidential, and appointment will be provisional pending the outcome of that clearance. Fingerprints will be taken on the day of the interview, and the social media accounts of shortlisted applicants may be accessed as part of verification. Shortlisted candidates may also be required to undertake pre-entry assessments, including a practical exercise and an integrity assessment, with further requirements applying to SMS-level posts.
